Terms and Conditions

General Conditions - The following general terms and conditions apply, however regional circumstances and regulations, contractual obligations to suppliers, and matters relating to location, service type and supply logistics may cause these to be varied for specific services, products, or destinations.

AfriXtreme has taken due care and responsibility to verify and check all information on our web site as at the time of compilation. However, as this information is supplied by the service providers, AfriXtreme accepts no responsibility for any inaccuracy or discrepancy contained in specific services and products offered.

Sales of services as contained in our publications are made by AfriXtreme only as agent for the person, business or company providing the services or products. The standards of accommodation and other services chosen are based on various factors, which are generally accepted as indicative of a certain class.  AfriXtreme does not accept responsibility for any change in prices or variation of services as shown, and all services and prices are subject to change without notice.

AfriXtreme does not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise, of the service providers in connection with the customer’s convention, pursuant to a contract between the service provider and the customer, and over which we have no direct control. We do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather conditions, acts of God, acts of Government or of any other authorities, accidents to or failure of machinery or equipment, or industrial action.  It is essential that the customer checks with AfriXtreme, or with the agent, for any changes to or variations in the information shown on our web site. This will allow us to advise the customer or the agent, of any such changes that we are aware of, before any services are booked.

Vouchers - A voucher is valid for four calendar months from date of purchase and is not transferable or assignable. AfriXtreme gift vouchers cannot be exchanged for cash. Because experiences are subject to availability and other conditions such as the weather etc, AfriXtreme will consider extending the validity of a voucher, but only upon receipt of a request in writing.  To redeem an AfriXtreme voucher and book the experience it covers, the recipient must quote the voucher code. If a voucher is misplaced, stolen or damaged, AfriXtreme may agree to replace it, subject to sufficient proof being provided, such as an affidavit. The voucher will be replaced and an administration fee of R100.00 will be payable

Web Rates & Price Variations - We reserve the right to vary prices and rates in the event of changes in exchange rates or price increases implemented by wholesalers or other service providers.  Should the cost of any service be increased, due to exchange rate fluctuations, price increases, tax changes or for any other reason, the customer will be required either to pay the difference when notified,  or cancel the booking, the latter of which may result in cancellation fees. AfriXtreme can not be held liable in any way for increases in fees. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change prior to the date on which an adventure takes place. All prices are subject to availability and can be withdrawn or varied without notice.

Web prices are correct at the time of online booking but AfriXtreme reserves the right to change the price of any advertised experience, without prior notice and prior to confirmation and receipt of full payment.

Confirmation - Since all AfriXtreme experiences are subject to availability, we recommend that customers book at least 14 days in advance, where possible for Extreme Adventures and as per requirement for other services such as Overland Tours, Safaris, Breakaways, Treats, Off-road and 4x4 Tours. Customers can regard a booking to be confirmed only when such confirmation has been provided by AfriXtreme. Until then, nothing is confirmed and we advise customers not to make arrangements for travel or accommodation until confirmation has been received.

Exchanges - A voucher may be exchanged only if the experience it covers is not available for any reason. Should the value of the new experience be higher than that specified in the voucher, the recipient of the voucher will be liable for the payment of the balance, in order for the exchanged experience to be confirmed. If the value of the new experience is less than that specified in the voucher, the recipient will receive a credit, to be used within four months of the expiry of the original voucher, for any future experience.

Cancellations and Refunds - Refunds will be possible only on experiences with an open date, at the discretion of AfriXtreme management. Refunds requested will incur an administration fee of 15% of the value of the experience.

Pre-booked experiences cannot be refunded but can be exchanged. This will, however, incur a cancellation fee of R100 if the experience is re-booked. No cancellations or exchanges of dates will be accepted within 14 days of a pre-booked experience. 

Should AfriXtreme be required to cancel or postpone an experience, there will be no charges incurred by the purchaser of the experience. We will notify the customer of the cancellation or postponement and offer an alternative date/ time where possible.

Limitations and Disclaimers - Purchasers and/or recipients and/or users of any AfriXtreme experience have no claim whatsoever against AfriXtreme with regard to the nature of any experience purchased. AfriXtreme and its suppliers cannot be held liable for the cancellation or postponement of any experience due to reasons beyond their control, such as unsuitable weather, acts of God, mechanical failure, etc. 

AfriXtreme partners with service providers that conform to our strict standards of safety and performance, but we cannot be held liable for any loss or damage suffered while participating in an experience. In purchasing and/or redeeming an AfriXtreme experience, the customer  purchasing and/or redeeming the voucher indemnifies AfriXtreme and its suppliers against any claim, damages or loss whatsoever.

AfriXtreme’s liability for any claim of breach of obligation regarding an experience voucher will not exceed the face-value of the voucher. This excludes claims arising from personal injury or death due to the negligence of AfriXtreme or anyone for whom we are responsible.
AfriXtreme will also not be liable to any customer or any other person for any loss of profit/special damages/consequential damages that result from a breach by AfriXtreme in terms of its obligations.

The Small Print - Every AfriXtreme experience is different and may have restrictions or certain conditions, outlined in the small print. Please make sure that you read this carefully to ensure that you comply and qualify. This includes any additional terms and conditions or indemnities of the suppliers themselves.

Intellectual Property Rights - All contents, trademarks and data on this website, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements are the property of, or licensed to, AfriXtreme and are therefore protected from infringement by local and international legislation and treaties.
